What is a stay of removal?

After an immigration judge issues an order of removal or orders an unlawful immigrant’s deportation, a stay of removal temporarily prevents or postpones the Department of Homeland Security (DHS) from carrying out or enforcing that order for removal. If an appeal is filed in a timely manner to the Board of Immigration Appeals (BIA) in a removal proceeding, then there may be an automatic stay of removal. The BIA also has the power to grant a discretionary stay of removal.

Who is eligible for a stay of removal?

After a removal proceeding, anyone who is ordered to be removed or deported may file an application for a stay of deportation or removal. Each family member should file their own application and also provide the required documentation along with their application. What is the 90-day removal period?

After a final removal order is issued against you, the federal government can detain you for up to 90 days while it arranges for your removal. After that, you may be eligible to be released from custody. However, you may be subject to supervised release or parole.

The 90-day period doesn’t start until after any appeals are resolved. If you receive a stay of removal, the 90-day period won’t start until the stay is no longer in effect.
